    Notes:

    On 16 December 1825 John James WESTWOOD, born Huddersfield YKS, trade - Face Drawer, aged 16 years, height 5' 4 1/2", enlisted in the 99th. Regiment of Foot at Bury in Lancashire. The regiment was at this time based in Ireland, but a number of recruiting detachments were sent to England, one of which was successful in recruiting Westwood. The successful detachment was based in Manchester and it made a number of two-day marches to nearby towns. He was paid a bounty of £4 on joining, with 16/- additional "bringing" money, possibly paid to a person who actually brought him to attest. His pay on enlistment was 1/- a day.

    From December 1825 to December 1826 he was a private, stationed at Birr in Ireland. From December 1826 to June 1827 at Clare Castle; from June to September 1827 at Ennis; from September 1827 to September 1828 at Youghal; from September 1828 to September 1829 at Charles Fort, Kinale; from September 1829 to December 1830 at Clare Castle; from January 1831 to December 1831 at Naas; from January 1832 to June 1832 at Armagh; from July 1832 to April 1833 at Drogheda. He served during all this period on various small detachments stationed in smaller outposts in Ireland. He was granted a furlough from 28 August to 10 October 1832. On 9 May 1833 he embarked for service overseas.

    On 7 September 1833 he disembarked at Flacq, Mauritius where he served until December 1833. From January 1834 to March 1835 he was stationed at Mahibourg, Mauritius where he served briefly in the Band. In April 1835 he moved to Port Louis, Mauritius where on 13 July of the same year he was promoted to Corporal. He remained at Port Louis until 14 June 1837 when he embarked for the return journey to Ireland. It is interesting to note that he acted as Regimental Harp for five days in March 1837. While in transit to Ireland on July 1837 he was promoted to Sergeant.

    He disembarked at Cork on 5 October 1837. Between that time and March 1839 he was variously based at Fermoy where he probably met his future wife, Mary ROACH, Kilkenny, Templemore and Athlone, engaged on detachment and escort duties. During this period many new recruits were enlisted. On 15 May 1839 Westwood was convicted on a charge of embezzlement, the penalty being reduction to the ranks and three months confinement. The entry relating to his return to duty appears to read "In Imprisonment by Court Martial" for 3 Calendar Months. Imprisonment commenced 21 May, released 20 August.

    From September 1839 he served as a private at Athlone and Dublin until September 1841. While in Dublin, he acted as Town Major's Adjutant and he received a 25 day furlough. In October 1841 he was transferred to Chatham, and on 4 November of the same year he was awarded a Good Conduct Badge. On 1 May 1842 he departed from Dublin for New South Wales aboard the "Isabella Watson", Master John A. MCDONALD, Surgeon Robert BOWER. On arrival in Hobart on 3 August 1842, 195 convicts were landed two having died and four having been put ashore in South Africa after a mutiny and disciplinary problems among the soldiers and convicts. It was a very fast passage for 1842 at 94 days. The 80 soldiers and their families restarted their journey on 20 August 1842 bound for Sydney.

    He disembarked at Sydney on 28 August 1842 and rejoined his regiment the following day. His first base was at Illawarra from September 1842 to March 1843. From 1843 to June 1844 he was stationed at Parramatta but served some of this period at both Illawarra or at Newcastle. On 1 April 1843 while again on detachment at Illawarra he was again promoted to Corporal and on 28 February 1844 he was awarded a second distinguishing mark (probably another Good Conduct Badge). From October 1844 he was posted to Sydney, though mostly on detachment at Newcastle.

    Between October and December 1844 he spent 57 days in hospital. Between January and March 1845 he spent a further 35 days in hospital. After 25 more days in hospital from 1 April he died on 25 May 1845. He had been promoted to Sergeant while in hospital on 30 April 1845, just three weeks before his death on 25 May 1845. It is interesting to speculate about this promotion for a moment. Perhaps his commanding officer saw the opportunity to secure a more generous pension for his widow but further research would be needed to establish this as fact. Perhaps he just wanted to wipe out the shame of his demotion six years earlier.

    Throughout his Army career John WESTWOOD seems to have been dogged by ill health. Soon after enlisting, between July and September 1826 he was hospitalised for 24 days; between January and March 1828, 28 days; between January and March 1833, 15 days; between January and March 1836, 45 days; between July and December 1838, 33 days; together with various shorter periods.

    As Sgt. WESTWOOD died while on active service no soldier's document was preserved, which is a great shame as it would have revealed much more interesting information.

    The burial of John James WESTWOOD

    John James WESTWOOD was buried at the Sandhills Cemetery, or as it was sometimes known the Old Devonshire Street Ground, which was located on what is now the site of Central Station, Sydney. In 1901, about 3300 monuments including the one belonging to JJW, were moved from the Sandhills Cemetery to a 25 acre site bounded by Bunnerong Road, La Perouse and the existing Botany Cemetery.

    The headstone is believed to have been in the Church of England section which is located close to Bunnerong Road. A transcription of the headstone is set out below.

    "John WESTWOOD, Sergeant of the 99th. Regt., died 25th. of May 1845, aged 38 years. Stone erected by his brother NCOs."

    Unfortunately, the headstone has not survived to the present day [1988] as friends visiting Sydney have looked for it without success. The ravages of time and particularly motor vehicle exhaust fumes are thought to have done the damage.

    When he was reduced to the ranks for embezzlement it appears that his sentence of three months detention was served on a prison hulk 'Cumberland' moored at Chatham in Kent.

    Owned a hotel in New Plymouth (Taranaki) NZ. This hotel was burnt to the ground in the late 1950s.

    Edward McGINTY was convicted of perjury (on behalf of his wife who was the licensee of a hotel in Melbourne) and sentenced to 5 years gaol with hard labour. The Victorian Index to Prisoners CD reveal the following: Edward McGINTY, page 384, male prisoners. Edward McGINTY, wife Mrs E. McGINTY in NZ, Edward McGINTY, Prisoner No: 28950. To freedom by remission: 8 Jun 1903.

    Margo (Marguerite) Leone Celestine McGINTY was at one time thought to have been a Catholic Sister (order unknown).
    Source: The will of Joseph McGINTY, her father, who says that she was in the Abbotsford convent at the time of the preparation of his will. It is now believed that this was incorrect and she might have been resident at the convent for reasons other than joining of an order.

    In 1900 her husband of four years William O'SHEA petitioned for divorce from Marguerite on the grounds of her adultery with Charles JOHNSTON. Both the respondent and the co-respondent had evidently been attendants at the Yarra Bend Lunatic Asylum. Marguerite had given birth to a son (William Thomas) by Charles JOHNSTON on 4 November 1898 at the Women's Hospital, Madelaine St., Carlton, VIC. He was registered as a son of her estranged husband, William O'SHEA.

    He did not return to the system although he was in contact with the department on several occasions including one instance where [sadly] he was refused the address of his youngest brother Arthur. The reason for the refusal appears to be they believed him "to be a wanderer and were unable to ascertain anything concerning his general character". He certainly did change his address many times as the records show him living in Port Darwin NT, Manly NSW, Preston VIC, Reservoir VIC and High St. Preston where he worked as an assistant cook for Mr. F.J. Vincent, Dairy Farmer. This confirms the family story that he worked as a cook. There is also a family legend suggesting that he spent some time in New Zealand and in the "islands".

    As was the custom, her term in that system expired on her eighteenth birthday (23 Aug 1899) presumably while she was still at Highton where she was in the care of a Mrs. COWAN. One can safely guess that this is where she first met her future husband Frederick Forbes HERD (1872-1944). On her record there is a note as follows: "girl is engaged to a young man named HERD, 29/4/01".

The first occurrences of problems with his "bad leg" are recorded in his record as he was admitted to the Melbourne Hospital on three occasions during 1899 and the Cheltenham address is that of Mrs. HARCOURT's Convalescent Home. His leg must have recovered to some extent as he absconded on Christmas Day 1899. There is an added note on his record as follows: "stopping temporarily at Mechanics Hotel, Bourke St. City. Has been employed mining at Broken Hill - 22/3/07".

    Invalid takes poison

    An inquest was held by the city coroner (Mr. Berriman) on Thursday into the death of Herbert SUMNER, which occurred at his home, 49 Moor Street, Fitzroy, on November 19. A sister of SUMNER said that her brother had been a cabinet maker, and was 36 years of age [sic]. He had been delicate all his life, and had been receiving an invalid pension.

    A finding of death by poison, self-administered, was returned.

    Drowned in the Tambo River
    Henry R. [sic] SUMNER, a groom employed at Davidson's Bruthen Inn, met his death by drowning, in the river on Sunday afternoon last. The day was very hot and [the] deceased with two companions, George SMITH and Andrew SMITH respectively, betook themselves to a deep hole in the river, about a mile from the town, for a swim. According to the evidence adduced at the enquiry they remained in the water for about two hours and had only got out, somewhere about 4 p.m., when a cry for help was heard from one of a number of lads who were bathing in the pool. SUMNER and Geo. SMITH immediately responded and Phillip KING, the lad who had appealed for help, having been put in a place of safety by SMITH, [the] deceased, who was within two yards of KING, suddenly called out "I am drowning" and sank. Most of those present thought he had dived but as he did not re-appear Andrew SMITH swam to the spot where he was last seen, but as he could not dive he was unable to render any aid. The alarm was given by Norman STRANGE and Constable HOWARD, Mr. C. DAVIDSON and Mr. G. McDOUGALL were quickly on the spot. The last named and others dived into the water which is about 13 feet in depth, but failed to locate the body. Grappling irons were subsequently obtained and the river dragged until nightfall, but without result. It was then determined to suspend operations for the night and to procure a boat for the morning. On Monday work was resumed by Messrs D.T. KING, Geo. McDOUGALL, Constable HOWARD and a number of others. After about an hours' searching the body was located and brought to the surface, and subsequently conveyed to the Bruthen INN.

    The deceased, Henry SUMNER, was about 20 years of age. He had been in Bruthen for the last twelve months, but is believed to have originally come from Bendigo. A brother lives at Sydney, a married sister at Belmont and an unmarried sister at Murrumbeena. SUMNER bore an exemplary character, being a sober and well behaved young fellow. The sum of 17 pounds was found in his room. Mr. HEARD, [sic] a brother in law of [the] deceased's, arrived in Bruthen on Tuesday and arranged for the burial to take place this afternoon.

    A magisterial enquiry as to the cause of death was held at Davidson's Hotel at 2:15 p.m. on Monday. Dr. BOND, J.P. acted as coroner and Constable HOWARD conducted the examination.

    Geo. Henry McDOUGALL, storekeeper, sworn, said:- I knew Henry SUMNER for the last six months; He had no relatives in Bruthen; in consequence of hearing something, I went to the Tambo River, near Mr. STIRLING's paddock, about 5 p.m.; I dived several times but did not succeed in finding anything; the river bed at that point is sandy and rocky and is about 13 ft. deep; on Monday morning I again proceeded with others to the river; we had procured a boat, and after an hour's search I found the body of [the] deceased in some 8 ft. of water, just about where he was last seen. The body was naked and the arms were doubled up close to the body; no marks of violence were visible; the body was about 25 ft. from the East bank of the river, and about 50 feet from the sandbank in the middle of the river. I identify the body as that of Henry SUMNER. I obtained the body on the lower side of the sunken sandbank amidst some rocks.

    Phillip Cardigan KING, a lad of 11 years, residing at Bruthen, deposed: I knew Henry SUMNER about six months; I remember Sunday 30th. December; I was swimming in the afternoon in the Tambo River, above Murphy's crop; there were a number of boys swimming there; there were three young men also present; their names were Andrew SMITH, George SMITH and Henry SUMNER; I was swimming to the sunken sandbank to go out when I got "puffed" and called out "Help! I am just about done." George SMITH ran down and jumping in swam to me and pushed me with his feet on to the bank; Henry SUMNER followed George SMITH and tried to swim to me and got within two yards when he called out "I am drowning"; I held my hand out to him but he did not offer to take it; his head sank below the surface and he was kicking; I did not see him alive again: there was no sign of him, not even a bubble: George SMITH was down on the log about 12 yards away; my brother Charlie was about six yards behind me; [the] deceased was in the habit of calling out in fun that he was drowning.

    Geoge Pentland SMITH, carpenter, Bruthen, sworn, said: I knew the deceased Henry SUMNER for about four months; I went for a swim about 3 p.m. with Andy SMITH and [the] deceased to a hole in the Tambo River, near Murphy's paddock; a number of lads arrived there about an hour later; all there present were swimming; [the] deceased was in about two hours: Harry SUMNER, Andy SMITH and myself had left the water and were dressing, when one of the boys named Charlie KING called out to me to go and help Phil KING, as he was getting done for; I ran round and swam across to Phillip KING and pushed him on to the sunken sandbank; I tried to get to Phillip KING again but the current was too strong, and as I was getting weak I swam with the current to a log on the Eastern side of the river; I did not see [the] deceased until I got to the log, when I saw his head go down as I turned round; I did not hear him call out and I did not see him alive again; [the] deceased told me he was subject to cramp in the toes; I was about 12 yards from [the] deceased when he went down; I was too exhausted to make any effort to save [the] deceased; Andrew SMITH went into the water, but I do not think he dived after him; [the] deceased was only a yard from the sandbank when he went down; the water at that part is about 12 ft. deep; I consider [the] deceased to have been a fair swimmer; during the afternoon [the] deceased several times put his head under water and pretended to be in danger; I believe [the] deceased exhausted himself in endeavouring to swim to Phillip KING against the current.

    Andrew SMITH, carpenter, of Bruthen, corroborated the evidence of the previous witness, adding, however, that had he not thought that [the] deceased was joking when he called out "I am drowning" he would have went to his aid at once. As it was, he jumped into the water and swam around several times, but did not dive as he had never done so.

    Charles DAVIDSON and Constable HOWARD also gave formal evidence.

    The Coroner found "That Henry R. (sic) SUMNER came to his death at Bruthen, on 30th. day of December 1906, from drowning by misadventure."

    By way of a rider, the Coroner said he should like to impress on parents generally the great risk in permitting children to bathe in unattended and dangerous holes in the river.

    Arthur Westwood SUMNER (aka HIDE) was not placed into the Neglected Childrens System as were his brothers and sisters at the time of his father's detention in Pentridge Prison in Dec 1890. His mother attempted to look after him until her sad demise (victim of murder) in Apr 1891 and one can only surmise that perhaps her parents looked after him until he was admitted as neglected child number 18609 on 5 Aug 1892. On 17 Aug 1892 he was probated to Mrs. HIDE of Richmond whose later address is shown as 15 Park Street, Abbotsford on 30 Oct 1905. His time as a neglected child expired on 9 Mar 1908 on his eighteenth birthday.
