    Notes:

    His wife, Rose Mary McGINTY, was unfortunately the victim of murder on 2 Apr 1891. The perpetrator of that crime was one John FINNIGAN who was sentenced to death. His sentence was commuted to life imprisonment with hard labour. FINNIGAN was released on 9 Dec 1907 with remissions for good behaviour etc.

    At the time of this tragic event Henry Thomas SUMNER was in gaol serving a sentence for counterfeiting of half-crown coins. According to newspaper accounts of the murder and trial five of the six children had been placed into the care of the Department of Neglected Children prior to the death of their mother, presumably on the conviction of their father for coining.     The second to last entry on his criminal record is as follows:
    28/6/96, Disorderly Conduct, 3 days sol conf cum [solitary confinement cumulative] ed.
    The puzzling thing about this entry is that it is long after his confinement in Pentridge Prison and about 5 months before his demise on 15 Nov 1896. Perhaps he took some leave from his labouring employment at Rutherglen and journeyed to Melbourne and fell off the wagon and drank too much, with predictable results.

    At his trial for counterfeiting, crown evidence was given against him by both his eldest son Charles Henry Joseph SUMNER, and eldest daughter Alice Rose SUMNER. Charles showed the police the hiding place used by his father for some of his plaster moulds. These reports also relate the fact that the marriage of Henry and Rose was strongly opposed by her parents (Joseph and Alice McGINTY). It is even stated that they took legal action in an attempt to secure an annulment of the marriage, presumably on the grounds of the age of Rose (18) or the fact that she married outside the Roman Catholic faith.

    The inquest was held at Rutherglen VIC before Mr. John O'GRADY, magistrate.

    Verdict of this inquiry was that "the said Harry SOMNER [sic] died at Rutherglen in the said Bailwick and Colony on the 15th. day of November 1896 from being accidentally burnt to death in his hut.

    Witness my hand this 16th. day of November one thousand eight hundred and ninety six."

    Several of the witnesses called to the inquest, clearly stated that Henry was sometimes of 'intemperate' habit with regard to alcohol consumption. This behaviour had been noted in different circumstances in earlier days.


    Died:
    Victorian Death Registration: 1896/15144 shows his age at death as being 36 years which is incorrect. It should be shown as 39 years.

    Employed as a labourer (sinking shafts) at the Great Southern and Chiltern mine, at Rutherglen in the north-east of Victoria.

    Charles Henry Joseph SUMNER (1880-1943) was committed to the Victorian Neglected Childrens System (No. 17808) on 24 Nov 1890 soon after the arrest of his father for coining (counterfeiting). He was fostered by people in the Bendigo area and later at Gisborne from where he absconded on 26 September 1894.

    He did not return to the system although he was in contact with the department on several occasions including one instance where [sadly] he was refused the address of his youngest brother Arthur. The reason for the refusal appears to be they believed him "to be a wanderer and were unable to ascertain anything concerning his general character". He certainly did change his address many times as the records show him living in Port Darwin NT, Manly NSW, Preston VIC, Reservoir VIC and High St. Preston where he worked as an assistant cook for Mr. F.J. Vincent, Dairy Farmer. This confirms the family story that he worked as a cook. There is also a family legend suggesting that he spent some time in New Zealand and in the "islands".

    Discharged in Melbourne on health grounds due to debility.

    Alice Rose SUMNER (1881-1954) was committed to the Neglected Childrens System (No. 17810) on 24 Nov 1890 soon after the arrest of her father for coining (counterfeiting). She was fostered at several addresses in the Bendigo area and later at Ascot Vale, Williamstown, Brunswick, Moonee Ponds, Cape Clear and Highton.

    As was the custom, her term in that system expired on her eighteenth birthday (23 Aug 1899) presumably while she was still at Highton where she was in the care of a Mrs. COWAN. One can safely guess that this is where she first met her future husband Frederick Forbes HERD (1872-1944). On her record there is a note as follows: "girl is engaged to a young man named HERD, 29/4/01".

    Herbert Edward SUMNER (1883-1923) was committed to the Neglected Childrens System (No. 17809) on 24 November 1890 soon after the arrest of his father for coining (counterfeiting). He was fostered at several addresses in the Bendigo area and later at Burnley and Cheltenham. The first occurrences of problems with his "bad leg" are recorded in his record as he was admitted to the Melbourne Hospital on three occasions during 1899 and the Cheltenham address is that of Mrs. HARCOURT's Convalescent Home. His leg must have recovered to some extent as he absconded on Christmas Day 1899. There is an added note on his record as follows: "stopping temporarily at Mechanics Hotel, Bourke St. City. Has been employed mining at Broken Hill - 22/3/07".

    Invalid takes poison

    An inquest was held by the city coroner (Mr. Berriman) on Thursday into the death of Herbert SUMNER, which occurred at his home, 49 Moor Street, Fitzroy, on November 19. A sister of SUMNER said that her brother had been a cabinet maker, and was 36 years of age [sic]. He had been delicate all his life, and had been receiving an invalid pension.

    A finding of death by poison, self-administered, was returned.

    Died at 49 Moore Street, Fitzroy. Arthur TUCKER, son in law of Joseph McGINTY lived in the same street. Same house?

    Source:- The will of Joseph McGINTY. A codicil to the will revokes a bequest of 50 pounds to Arthur TUCKER. I wonder what he did to deserve this treatment?

    Drowned in the Tambo River
    Henry R. [sic] SUMNER, a groom employed at Davidson's Bruthen Inn, met his death by drowning, in the river on Sunday afternoon last. The day was very hot and [the] deceased with two companions, George SMITH and Andrew SMITH respectively, betook themselves to a deep hole in the river, about a mile from the town, for a swim. According to the evidence adduced at the enquiry they remained in the water for about two hours and had only got out, somewhere about 4 p.m., when a cry for help was heard from one of a number of lads who were bathing in the pool. SUMNER and Geo. SMITH immediately responded and Phillip KING, the lad who had appealed for help, having been put in a place of safety by SMITH, [the] deceased, who was within two yards of KING, suddenly called out "I am drowning" and sank. Most of those present thought he had dived but as he did not re-appear Andrew SMITH swam to the spot where he was last seen, but as he could not dive he was unable to render any aid. The alarm was given by Norman STRANGE and Constable HOWARD, Mr. C. DAVIDSON and Mr. G. McDOUGALL were quickly on the spot. The last named and others dived into the water which is about 13 feet in depth, but failed to locate the body. Grappling irons were subsequently obtained and the river dragged until nightfall, but without result. It was then determined to suspend operations for the night and to procure a boat for the morning. On Monday work was resumed by Messrs D.T. KING, Geo. McDOUGALL, Constable HOWARD and a number of others. After about an hours' searching the body was located and brought to the surface, and subsequently conveyed to the Bruthen INN.

    The deceased, Henry SUMNER, was about 20 years of age. He had been in Bruthen for the last twelve months, but is believed to have originally come from Bendigo. A brother lives at Sydney, a married sister at Belmont and an unmarried sister at Murrumbeena. SUMNER bore an exemplary character, being a sober and well behaved young fellow. The sum of 17 pounds was found in his room. Mr. HEARD, [sic] a brother in law of [the] deceased's, arrived in Bruthen on Tuesday and arranged for the burial to take place this afternoon.

    A magisterial enquiry as to the cause of death was held at Davidson's Hotel at 2:15 p.m. on Monday. Dr. BOND, J.P. acted as coroner and Constable HOWARD conducted the examination.

    Geo. Henry McDOUGALL, storekeeper, sworn, said:- I knew Henry SUMNER for the last six months; He had no relatives in Bruthen; in consequence of hearing something, I went to the Tambo River, near Mr. STIRLING's paddock, about 5 p.m.; I dived several times but did not succeed in finding anything; the river bed at that point is sandy and rocky and is about 13 ft. deep; on Monday morning I again proceeded with others to the river; we had procured a boat, and after an hour's search I found the body of [the] deceased in some 8 ft. of water, just about where he was last seen. The body was naked and the arms were doubled up close to the body; no marks of violence were visible; the body was about 25 ft. from the East bank of the river, and about 50 feet from the sandbank in the middle of the river. I identify the body as that of Henry SUMNER. I obtained the body on the lower side of the sunken sandbank amidst some rocks.

    Phillip Cardigan KING, a lad of 11 years, residing at Bruthen, deposed: I knew Henry SUMNER about six months; I remember Sunday 30th. December; I was swimming in the afternoon in the Tambo River, above Murphy's crop; there were a number of boys swimming there; there were three young men also present; their names were Andrew SMITH, George SMITH and Henry SUMNER; I was swimming to the sunken sandbank to go out when I got "puffed" and called out "Help! I am just about done." George SMITH ran down and jumping in swam to me and pushed me with his feet on to the bank; Henry SUMNER followed George SMITH and tried to swim to me and got within two yards when he called out "I am drowning"; I held my hand out to him but he did not offer to take it; his head sank below the surface and he was kicking; I did not see him alive again: there was no sign of him, not even a bubble: George SMITH was down on the log about 12 yards away; my brother Charlie was about six yards behind me; [the] deceased was in the habit of calling out in fun that he was drowning.

    Geoge Pentland SMITH, carpenter, Bruthen, sworn, said: I knew the deceased Henry SUMNER for about four months; I went for a swim about 3 p.m. with Andy SMITH and [the] deceased to a hole in the Tambo River, near Murphy's paddock; a number of lads arrived there about an hour later; all there present were swimming; [the] deceased was in about two hours: Harry SUMNER, Andy SMITH and myself had left the water and were dressing, when one of the boys named Charlie KING called out to me to go and help Phil KING, as he was getting done for; I ran round and swam across to Phillip KING and pushed him on to the sunken sandbank; I tried to get to Phillip KING again but the current was too strong, and as I was getting weak I swam with the current to a log on the Eastern side of the river; I did not see [the] deceased until I got to the log, when I saw his head go down as I turned round; I did not hear him call out and I did not see him alive again; [the] deceased told me he was subject to cramp in the toes; I was about 12 yards from [the] deceased when he went down; I was too exhausted to make any effort to save [the] deceased; Andrew SMITH went into the water, but I do not think he dived after him; [the] deceased was only a yard from the sandbank when he went down; the water at that part is about 12 ft. deep; I consider [the] deceased to have been a fair swimmer; during the afternoon [the] deceased several times put his head under water and pretended to be in danger; I believe [the] deceased exhausted himself in endeavouring to swim to Phillip KING against the current.

    Andrew SMITH, carpenter, of Bruthen, corroborated the evidence of the previous witness, adding, however, that had he not thought that [the] deceased was joking when he called out "I am drowning" he would have went to his aid at once. As it was, he jumped into the water and swam around several times, but did not dive as he had never done so.

    Charles DAVIDSON and Constable HOWARD also gave formal evidence.

    The Coroner found "That Henry R. (sic) SUMNER came to his death at Bruthen, on 30th. day of December 1906, from drowning by misadventure."

    By way of a rider, the Coroner said he should like to impress on parents generally the great risk in permitting children to bathe in unattended and dangerous holes in the river.

    Victoria Beatrice (Queenie) SUMNER (1887-1958) was committed to the Neglected Childrens System (No. 17812) on 24 Nov 1890 soon after the arrest of her father for coining (counterfeiting). She was fostered at several addresses in the Bendigo area and later at Murrumbeena, Kongwak and Geelong. She absconded in 1903 only to return after two days. Her record also shows the sad fact that she was fitted with an artificial eye at the Eye and Ear Hospital after an accident on 26 August 1901.

    Arthur Westwood SUMNER (aka HIDE) was not placed into the Neglected Childrens System as were his brothers and sisters at the time of his father's detention in Pentridge Prison in Dec 1890. His mother attempted to look after him until her sad demise (victim of murder) in Apr 1891 and one can only surmise that perhaps her parents looked after him until he was admitted as neglected child number 18609 on 5 Aug 1892. On 17 Aug 1892 he was probated to Mrs. HIDE of Richmond whose later address is shown as 15 Park Street, Abbotsford on 30 Oct 1905. His time as a neglected child expired on 9 Mar 1908 on his eighteenth birthday.

    Fred enlisted in the Australian Regular Army on 7 Jan 1960, firstly spending three years at the Army Apprentices' School in Balcombe VIC where he undertook training as a Radio Technician. On graduation (as App/Staff Sgt.) he joined RAEME (Royal Australian Electrical and Mechanical Engineers) to complete his training as a Radar Technician. During the next six years he was posted to Moorebank NSW, Bandiana VIC, Woomera SA, Holsworthy NSW, Nui Dat South Vietnam (Australian Force Vietnam) and finally to Albert Park Barracks in Melbourne VIC. During that time he was promoted to the rank of Temporary Staff-Sergeant. Fred is often heard to say that he does not regret one minute of his time in the Army and his first love is still anything to do with radar.

    Short periods working at Laverton and back in Geelong followed his discharge, prior to joining the staff of the Gordon Institute of Technology as an Electronics Technician in the Physics Department. Over the following 33 years he working firstly for that institution and then Deakin University where he was a Senior Technician in the School of Biological and Chemical Sciences Workshop. His duties in the workshop include a considerable input into many research projects. A consequence of this is that Fred has co-authored several scientific papers particularly in the area of electronic instrumentation as applied to electro-chemistry. Retirement from the workforce came on 28 Nov 2003 when Fred was very graciously farewelled from Deakin University. Since retirement it is very difficult to see where work fitted into the scheme of things!

    On 22 Aug 1970 Fred married Ruth Elaine WARD at Ashby Methodist Church, Manifold Heights. Fred and Ruth have two children, Jennifer Lorraine who is married to Brad PHILP has three children from an earlier marriage - Lyndall, Claudia and Patrick. Son, Bradley Frederick completed a post-graduate diploma majoring in voice after completing a four year B. Mus under-graduate degree at the Conservatorium of Music at the University of Tasmania in Hobart. He currently is employed as a Manager Learning and Social Techniques at the Geelong Grammer School, Corio VIC.

    Fred was a foundation member of the Genealogical Society of Victoria, Geelong Group (now the Geelong Family History Group Inc.) and he has held the offices of president and secretary of that group. He is still very much an active researcher looking at many names and has with the help of his family transcribed the cemeteries at Steiglitz, Lorne, Birregurra and Sutherland's Creek. He has also jointly indexed and published the Admission Books of the Geelong Infirmary and Benevolent Asylum with Heather COX who coincidentally also has very strong connections with the Victorian town of Casterton. More recent projects have been the editing of the Pre-registration Burials from Christ Church, Geelong and the placing of the Admission Books mentioned above on the world wide web.

    Fred's great grandfather, Ambrose Willcock WALTER (1833-1915) is an abiding interest as is the early history of the Barrabool Shire where Ambrose was an early councillor.

    The highlight of Fred's family history search will be the day he manages to locate the death of Henry Thomas SUMNER (1857-?) a maternal great grandfather, last known leaving Pentridge Gaol on 22 July, 1892.

    8 Jan 1969: Appointed as a electronics technician by Hawker de Havilland Australia to work as a civilian with the RAAF at the Laverton Transmitter Station. Without a doubt the most boring and uninteresting job I have ever experienced.

    Apr 1969: Cut my losses and took a job with a local electronics firm servicing domestic appliances. Not to be recommended to anybody!

    21 Apr 1970: Applied for and obtained a position as a Laboratory Technician with the Gordon Institute of Technology in Geelong. Technician in charge of the Physics Workshop until Apr 1977. With the exception of Woomera the most interesting time of my professional life.

    22 Aug 1970: Married Ruth WARD who is a Teacher/Librarian at a local Lutheran primary school. We have two children. Jenny, b. 1972, who is a housewife and Brad, b. 1974, who is a Manager Learning and Social Techniques and trained singer.

    1 Apr 1977: Gordon Institute of Technology and Geelong Teachers' College amalgamate to form Deakin University and I become Senior Technician in the Faculty of Science Workshop (now the Biological & Chemical Sciences Workshop). Responsibilities are mainly designing and building electronics equipment for research purposes in all parts of the faculty including Chemistry and Biological Sciences. We do a lot of work with PCs and build dedicated microcomputers, particularly for Electrochemistry.

    28 Nov 2003: Retirement from Deakin University.

    My other interests these days include a passion for history and particularly family history which afflicted me about 1978. I have been president and secretary of the Geelong Family History Group Inc.

    Army Man Back From Vietnam

    Sergeant Frederick Walter, eldest son of Mr. and Mrs. S.F. Walter, of Merrawarp Road, Ceres, returned recently by charter flight after 12 months service as a radar technician with the Australia Task Force in Vietnam.

    After graduating at Balcombe Army Apprentices' School, he was stationed at Moorebank, near Sydney for 18 months, then posted to Woomera Weapons Research Establishment for two and a half years.

    Sergeant Walter, who is in his ninth year of service with the Regular Army, has acquired a varied and interesting collection of colored slides covering Woomera, Taiwan, Singapore and Vietnam.

    On completion of leave he is to be posted to Army Headquarters, Melbourne.

    The midwife in attendance at the birth of Frederick Lionel WALTER (1943- ) was the much-loved and well-known Sister PONTING (married name: Florence Maud Ann ELDRIDGE, 1902-1997).

    Fred and his parents, along with his brothers (Ken and Denis) and sister (Helen), lived in several places mainly in Geelong and district including Paraparap, Rockbank, Leopold, Torquay, Bellbrae, Wangaratta, Belmont and Ceres.

    Saw active service between 11 May 1967 and 23 Apr 1968 as a Sergeant radar technician with Detachment, 131 Divisional Locating Battery Workshop, RAEME, part of the Australian Task Force at Nui Dat in Phuoc Tuy Province, South Vietnam. Discharged on 6 Jan 1969 with the rank of Staff-Sergeant.

    Notes:

    Janet Louise WALTER was born in Ward 6 of the Geelong Hospital on 30 Nov 1950. Unfortunately, she was afflicted by severe Down's Syndrome and suffered a severe congenital mental deficiency.

    Little is known of her short life but we do know that she was admitted to Kew Cottages on 1 May 1951 where she progressed fairly well until 17 May 1951. She became very ill and died at 4:00 p.m. on 21 May 1951.

    On 25 May 1951 an inquest (No. 706 of 1951) was held into her death (No. 5292 of 1951) and the cause of death was established as broncho pneumonia. The undertaker employed for her funeral was W.V. Raven, 227 Smith St., Fitzroy. She is buried at the Springvale Botanical Cemetery in an unmarked grave (Ref. No. 161510, CofE Area, Denominational Grave, Location L19/23) in an area where unmarked graves seem to be the norm.
